Terms & Conditions

The following terms and conditions shall impliedly come into force once the customer has initiated their subscription for any of Aero Station’s Software As A Service (SaaS) Product.

License and Intellectual Property

  1. Aero Station is the owner of copyright and all other intellectual property rights in the ERP system (the “Product”).
  2. Aero Station grants the Customer a non-exclusive license to use the Product, subject to the terms and conditions outlined hereinafter.
  3. The Customer is deemed to have read, understood, and agreed to be bound by the terms of this Agreement upon purchasing the Product subscription license.

Usage Restrictions

  1. The Customer shall not decompile, disassemble, or otherwise modify the Product, except as explicitly allowed under this license.
  2. The Customer is solely responsible for determining the suitability of the Product for its intended purpose before purchasing the subscription license. Once the license is purchased, Aero Station will not accept refunds, and payments made shall be non-refundable.

Product Editions and Installation

  1. The Product may be offered in different editions based on features, pricing, modules, etc.
  2. As of now, all SaaS Products offered by Aero Station are Web Based and cannot be installed locally.
  3. Usage of the Product necessitates an active Internet connection.

Technical Support, Maintenance, and Upgrades

  1. Technical support, maintenance, and upgrades are included in the subscription license.
  2. Aero Station may perform routine maintenance and backups to ensure optimal performance and security of the services.
  3. After the release of a new version, further development and debugging will only be conducted on the new version, which may be subject to additional terms and conditions.

Training

  1. Free training to use the Products will be provided via Google Meet or Zoom, up to a maximum of 10 hours in divided sessions.
  2. Installation, training, and support beyond the included services are chargeable.

Customization and Development

  1. Extra customization or development beyond the standard Product features is not included for SaaS based Products. However, routine upgrades may be done to improve the features of the existing Product.

Hosting and Security

  1. The ERP system will be hosted on Aero Station’s servers.
  2. Aero Station employs industry-standard security measures to protect customer data. However, the Customer is responsible for the confidentiality and security of their access credentials and data.
  3. Aero Station shall not be responsible for any data breaches, unauthorized access, or data loss resulting from the Customer’s actions or inactions.

Backups

  1. In the event of server downtime or a crash, the most recent backup will be restored, and services will be reactivated as soon as possible.
  2. The Customer is responsible for generating and securely storing backups of their database using the Backup/Restore option.

Liability

  1. Aero Station shall not be liable for any data corruption at the Customer’s site due to media failure, power failure, hardware problems, virus infections, or any other reason. Data recovery services, if needed, will be chargeable.
  2. Aero Station shall not be liable for any loss or damage, whether direct, indirect, special, consequential, or incidental, arising from the use or application of the Product.

Statutory Compliance

  1. The Statutory Reports provided in the Product are intended to assist the Customer in fulfilling various statutory obligations. Aero Station does not guarantee the accuracy, completeness, or adequacy of the information provided in these reports and makes no claim that they will be accepted by the relevant authorities.
  2. Aero Station shall not be responsible for any error, omission, or delay in fulfilling statutory obligations by the Customer. While Aero Station may incorporate changes in statutory requirements in future releases of the Product, it is under no obligation to do so.

Termination

  1. Aero Station reserves the right to terminate or suspend the Customer’s access to the ERP system with or without notice for any reason, including but not limited to breach of these terms and conditions, non-payment, or any activity that compromises the security or integrity of the system.

Price Changes

  1. Aero Station may change or revise prices without prior notice. The revised prices will be effective upon the upcoming subscription renewal.

Legal Compliance

  1. These terms and conditions are subject to all just and legal exceptions prescribed under the state law.
  2. This agreement is governed and interpreted in accordance with the laws of Pakistan.
  3. Any disagreement arising between the parties out of or in link with this Agreement will be finally resolved by adjudication conducted by one authority in Pakistan. Each party will bear its own costs and lawyers’ fees, and will share equally in the fees and expenses of the authority.
  4. The provisions in this section do not restrict the Licensor’s ability to seek legal or equitable remedies or to obtain an injunction to safeguard any rights related to the Product and/or Services or the Licensor’s intellectual property rights. A breach of this Agreement by the Customer will cause the Licensor irreparable harm for which no adequate legal remedy exists. In the event of an actual or threatened breach of this Agreement by the Customer, the Licensor is entitled to seek injunctive relief and any other appropriate remedies from a competent court.
